The Texas Commission of Licensing and Regulation (TCLR) is TDLR's governing body — seven public members appointed by the Governor. The Commission is the rulemaking authority: it adopts the rules in 16 TAC, sets fee schedules, and approves the policy changes that reshape requirements, like CE restructurings.
The division of labor:
- TCLR (the Commission) adopts rules, fees, and enforcement policy, acting under authority the Legislature granted in the Occupations Code
- TDLR (the department) runs everything day to day — processing applications and renewals, administering exams, approving CE providers and courses, investigating complaints, and enforcing the rules
- Advisory boards for each trade — such as the Advisory Board on Barbering and Cosmetology and the ACR Contractors Advisory Board — advise the Commission on industry-specific matters before rules are adopted
So when a CE requirement changes, the typical path is: the Legislature passes a bill, the trade's advisory board weighs in, the Commission adopts implementing rules in 16 TAC, and TDLR administers the new requirement at renewal time.
What it means for your renewal
For a licensee the distinction is mostly practical: rule changes and fee changes come from Commission meetings (worth a glance when TDLR announces proposed rules for your trade), while your renewal, CE record, and any enforcement contact all go through TDLR the department.
